1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the Geoscope Solutions website and environmental intelligence platform (the "Service"), operated by Geoscope Solutions ("Geoscope," "we," "our," or "us"). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Geoscope provides environmental database screening, GIS mapping, historical reference research, and related report deliverables intended to support environmental due diligence, property research, and risk review. The Service is a research and reporting tool. It is not a substitute for a Phase I Environmental Site Assessment, a site inspection, or the professional judgment of a qualified Environmental Professional.
3. Eligibility & Account Registration
You must be at least 18 years old and able to form a binding contract to use the Service. When you register for an account, you agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.
Geoscope may suspend or terminate accounts that provide false information, violate these Terms, or are used for unauthorized or fraudulent purposes.
4. Orders, Pricing & Payment
Report prices are displayed at the time of order and are due in full before an order is processed unless otherwise agreed in writing. Geoscope reserves the right to change pricing at any time; changes do not affect orders already confirmed and paid for.
Typical turnaround times are estimates, not guarantees, and may vary based on property location, report complexity, and data source availability. Refunds are considered on a case-by-case basis and are not automatic once an order has entered production. See our Refund Policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation
- Attempt to gain unauthorized access to the Service, other accounts, or Geoscope's systems
- Scrape, resell, sublicense, or redistribute report data or platform content without written permission
- Interfere with or disrupt the integrity or performance of the Service
- Misrepresent your identity or affiliation when placing an order
6. Report Reliance & Professional Disclaimer
Geoscope reports compile and organize information from government databases, historical records, and other third-party sources. While we maintain quality-assurance processes, environmental data can contain source-level errors, gaps, or timing lags outside of our control.
Reports are provided as an information resource for due diligence and are not a legal opinion, environmental liability determination, or guarantee that every environmental condition or record has been identified. Geoscope does not perform or certify a complete Phase I Environmental Site Assessment. Decisions based on a Geoscope report should be reviewed by a qualified Environmental Professional, attorney, or other licensed advisor as appropriate to your transaction.
7. Intellectual Property
The Service, including its software, design, mapping tools, and original content, is owned by Geoscope Solutions and protected by applicable intellectual property laws. Your report deliverable is licensed to you for your internal business and due-diligence use; underlying platform technology, report templates, and aggregated database infrastructure remain Geoscope's property.
8. Third-Party Data Sources
Geoscope aggregates data from government agencies and licensed third-party providers. We do not control the accuracy, completeness, or update frequency of source data and are not liable for errors originating from third-party datasets. Where a database or source is discontinued or restricts redistribution, Geoscope may adjust the affected coverage without notice.
9. Limitation of Liability
To the fullest extent permitted by law, Geoscope Solutions and its officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or reliance on a report, including but not limited to lost profits, lost data, or transaction losses. Geoscope's total liability for any claim relating to the Service is limited to the amount you paid for the applicable report or subscription in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold Geoscope Solutions harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service, violation of these Terms, or violation of any third-party right.
11. Termination
Geoscope may suspend or terminate your access to the Service at any time for violation of these Terms. You may close your account at any time by contacting us. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States and the state in which Geoscope Solutions is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation between the parties before pursuing formal proceedings.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. For material changes, we will notify active clients via email. Continued use of the Service after an update constitutes your acceptance of the revised Terms.
